Throughout this document, the following terms carry the meanings set out below:

Acceptance of Terms

By submitting an enquiry form, registering for a programme, or attending a session, you agree to be bound by these Terms and Conditions.

• Participants must be 18 years of age or older, or be accompanied by a consenting adult guardian.
• You confirm that you have the legal capacity to enter into this agreement under Malaysian law.
• If you are joining on behalf of another person (such as a family member), you confirm you have their consent and authority to do so.

Service Description

Usiawan offers movement education and active living programmes designed for older adults in the Kuching area. Our current offerings include:

All services are offered in the Kuching, Sarawak area. We reserve the right to adjust session content, scheduling, or format with reasonable notice to participants. Session availability may vary during public holidays.

Participation

Our sessions are designed to be gentle and community-minded. To make them safe and comfortable for everyone:

• Participants join at their own pace and are not required to perform any activity beyond their personal comfort.
• You are responsible for informing a relevant personal contact of any ongoing conditions that might affect your ability to participate.
• Usiawan does not provide regulated professional assessments. All sessions are general movement education only.
• If at any point you feel unwell during a session, you should stop and notify the session facilitator.

User Responsibilities

When using our website or attending our programmes, you agree to:

• Provide accurate and current contact information when submitting enquiries.
• Treat other participants, staff, and facilitators with courtesy and respect.
• Arrive on time and notify us in advance if you are unable to attend a booked session.
• Not record, photograph, or share images of other participants without their explicit consent.
• Not use our website for any unlawful, harmful, or disruptive purpose.

Prohibited activities include: submitting false information, attempting to access parts of the website not intended for public use, sending unsolicited communications to other participants, or reproducing our content without written permission.

Intellectual Property

All content on the Usiawan website — including session guides, printed routines, written descriptions, photographs, and design elements — is the property of Usiawan or its content providers.

You are granted a limited, personal, non-transferable licence to access and view our website content for your own private use. You may not:

• Copy, reproduce, or distribute our content without written consent.
• Use our name, logo, or materials for any commercial purpose.
• Modify or create derivative works based on our session materials.

Payment Terms

All prices are quoted in Malaysian Ringgit (RM) and are subject to change. Payment arrangements will be confirmed at the time of booking.

• Accepted methods: We will communicate accepted payment methods directly upon booking confirmation.
• Cancellations: Please contact us at least 48 hours before a session if you need to cancel. Late cancellations may not be eligible for rescheduling at no additional cost.
• Refunds: Refund requests are assessed on a case-by-case basis. We aim to be reasonable and will consider each situation individually.
• Membership: The Active Living Membership covers a defined programme period. Early discontinuation does not entitle the participant to a pro-rated refund unless agreed in writing.

Disclaimers

Our services are provided as general movement education and community activities. They are not a substitute for professional advice from a qualified practitioner.

• Usiawan does not make any representations about the outcome of participation in our programmes for any individual.
• Information shared during sessions is of a general educational nature only.
• Our website and materials are provided on an "as available" basis. We do not warrant that the website will always be error-free or uninterrupted.
• We are not responsible for the content of external websites linked from our pages.

Limitation of Liability

To the extent permitted by law in Malaysia, Usiawan shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or participation in our programmes.

Our total liability for any claim arising in connection with these Terms shall not exceed the amount you paid for the specific programme to which the claim relates.

We are not responsible for events beyond our reasonable control, including but not limited to natural disasters, public health directives, or utility disruptions affecting our venue.

Indemnification

You agree to hold harmless and indemnify Usiawan, its staff, and facilitators from any claims, losses, or expenses arising from your breach of these Terms, your misuse of our services, or any false information you have provided to us.

Termination

Either party may discontinue participation or service provision with reasonable written notice.

• Usiawan reserves the right to decline or discontinue service to any individual who breaches these Terms or whose conduct is disruptive to the group environment.
• Upon termination, your right to attend sessions ceases immediately.
• Clauses relating to intellectual property, disclaimers, and limitation of liability shall survive termination.

Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of any dispute, we encourage you to first contact us directly at [email protected] so we can seek an informal resolution.

If an informal resolution is not reached within 30 days, either party may refer the matter to the appropriate courts in Sarawak, Malaysia, whose jurisdiction shall be exclusive to any claims arising from these Terms.

Your statutory rights as a consumer under Malaysian law, including the Consumer Protection Act 1999, are not affected by these Terms.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Usiawan regarding use of our services.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.
• Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
• Notices: Written notices may be sent to us at [email protected] or by post to our Kuching address.

Changes to Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. When we do, the revised Terms will be posted on this page with an updated "Last Updated" date.
